Do you know the meaning of intellectual property? Have you heard anyone talking about copyright? If you consider yourself as a creator, craftsman or inventor and you have never heard about these terms, you are at a great disadvantage. Intellectual property is all that is protected by the copyright laws, legally guaranteeing the creators' interests by offering them exclusive privileges in relation to their inventions, which can be literary and artistic works, symbols, names, images, drawings and models used in the world of commerce. For the World Intellectual Property Organization, any invention of the human mind is considered part of the intellectual property, however, the delimitation of what constitutes an intellectual property depends on the laws and is under constant renovation. In this field, our consultants in trademark registration can provide you with the orientation and the required management to have your creations duly protected.
The importance of being aware of the implications of the copyright, especially for the people who frequently make known new inventions of their authorship and present innovations in the creative field, it's a must. Copyrights are only a group of legal standards and principles that confirm the moral and patrimonial rights that the law grants to authors for the creation of a literary, artistic, musical, scientific or didactic work, published or unpublished, besides that, is one of the fundamental human rights included in the World Human Rights Declaration. In the case of Colombia, the National Direction of Copyrights is the institutional body belonging to the Colombian State in charge of the design, management, administration, and implementation of the government policies in the field of copyrights and related rights.
Throughout the history, several international copyright treaties have been signed to approve reasonably protection of copyright from country to country. They establish standards of protection that each country will apply according to its own copyright law. These treaties are: Berne Convention, WIPO Copyright Treaty and the Agreement on Trade-Related Aspect of Intellectual Property Rights (TRIPS); all of them include their standards of protection, limitations, and duration. Copyright duration can be different from country to country, depending on the type of work, it varies from a minimum of 50 years after the author dies until 70 years, this rule is usually called "life plus 70".
To be concerned about defending the rights of a work is to ensure the integrity of its creation, the essence of its meaning or utility and the benefits of multiple nature that the consequences caused by a work can generate to its author. When the rights of a work are violated, both in the digital world or in the conventional world, the holder of the rights can appeal to the benefits conferred by law to begin civil actions, which allow –through a lawyer– to submit a demand in a lawsuit in order for a judge to solve the issues that arise with the purpose of applying the prerogatives.
